SSP has nothing to do with an employment contract. An employee can receive SSP for a maximum of 28 weeks for one period of sickness. One period of sickness includes absences that are separated by no more than56 days, which count as linked absences. A series of linked absences can last for 3 years, but the SSP is still only payable for 28 weeks. After that time the employee can claim the equivalent of sickness benefit from the DWP.

An employer can continue to employ someone who is unable to work due to ill health, or they can take steps under their capability procedure to dismiss someone who is incapable of carrying out their contract. That can happen at any time during an ill health absence.
