IPO Trademark and Amazon Brand Registry

    I have applied for Right Start with IPO trademark office..
    It is a logo mark, which is a 5 letter word, in graphic logo format.. Or as they stated on the app form 'figurative'.
    I am wanting to sell on Amazon and start their brand registry so I can sell my branded product on Amazon.
    Will this 'figurative' trademark be enough for Amazon brand registry???
    As apparently it is not a word trademark.. ??
    I am unsure now whether to pay the remaining £100 on Right Start.

    It was not made clear that I could choose both.. Now I will have to start the right start again won't I and pay another £100.. or in other words I have wasted £100?!

    You need a word mark for brand registry on Amazon. They won't accept a figurative trademark for brand registry. Don't bother trying to trademark your actual logo, just the name itself.
    Bloody Ell.. Nowhere was thids made clear on Brand Registry!
    Can you apply for both on the IPO process, as in may as well get both whilst you are at it or is it just one, again this wasn't very clear as I was going through it all.

    Reading the brand registry guidance, Amazon actually should accept a 'Design Mark', though my experience is that they tend to not accept them so you could try to push Amazon to accepting the trademark once you have it.

    That said, you still have far more protection registering the brand name as a word mark rather than the logo itself so personally I'd just swallow the £100 you've already paid and go for the word mark.

    • The trademark for your brand must be in the form of a text-based mark (word mark) or an image-based mark with words, letters or numbers (design mark). Note that trademarks can have different classifications based on their issuing trademark office.
    • Your trademark text must match the brand name on your Brand Registry application. If your trademark is an image-based mark with words, letters or numbers, you will need to upload a copy of the image during enrollment. It should match your trademark record exactly.

    Sorry - been away on holiday for a couple of weeks. Just got back last night so playing catch up.

    The others have pretty much covered it but to summarise...

    - Amazon accepts both word marks and design marks for the BR but the design mark must be logo and text. It can't be just be an image. And it must match what you have registered with the IPO exactly.

    - you don't need to wait it to be registered. As soon as you get the UK000 number you can register with the BR. You will need photos of the physical product showing the trademark on the product/packaging. Just take these on your phone (they shouldn't be edited) to prove that the product actually exists and that you aren't trying to use the BR to product a generic product

    Genuine question...is this something relatively new? I ask because whenever we've registered trademarks we've had to wait for the trademark to be approved before Amazon would allow us to register it under Brand Registry.

    It has been like this for a while now although I can't remember exactly when it changed. At least a year I would say, possibly more. As soon as you have that UK000 number you can apply and be accepted to the BR, normally within 48 hours.

    Slightly out of my area now and I don't want to give bad advice. Clients normally register the word mark as standard so I haven't seen this for a while but it sounds within what Amazon allows.
