Ideally this would go in the Human Resources forum, though there isn't one so I'm sticking it here and hoping someone can help.

We have a guy from Turkey who is looking to do an internship with us over the summer.

I've been impressed by his attitude and aptitude so am more than happy to have him, but someone mentioned that there may be issues due to the fact that he is from Turkey?

I'm no expert on this kind of thing

Does anyone know if there are any legal issues with regards to this?

thanks in advance

Does he currently have any visa? If he is on a student visa, he should be fine working for you during his holidays. If he doesn't have visa, then it would be much more complicated, in fact probably not worth the effort.

You can check the home office website for more details.

Be very careful.

It is your obligation to ensure he has a right to work in the UK. Turkey are not yet in EU.

I would check with the Border Agency

http://www.bia.homeoffice.gov.uk/workingintheuk/turkish/

You must photocopy and keep all the paperwork you see There is a list of acceptable documents. Not just see it.

If the border agency come knocking you will have to prove you took all reasonable steps to ensure your employee has a right to work in the UK

Foreign Students generally do not have a right to work. They are here to learn!!

not true. Most students are able to work for 20 hours per week during studies and full time during holidays. Check the visa, it will not be allowed to work if it says 'No Work'. Definitely check passport and visa, if he is a student you should be fine, but do check.

OK I looked into this and the conclusion I got after a call with the UK borders agency is that the short answer is no this isn't possible.

He's from a Uni in Turkey, so he's not studying here.

The only way he could come here to work would be to get some kind of authorisation from what they call an "overarching body".

There is a list of these and the only one that looks relevant to me will charge me £750 for the pleasure of applying with no guarantee that the application will be accepted nor much information about what determines if it will be accepted or not.

What a shame :/
