Insurance for White Label

Hi guys,

I hope you can help me, because I am feeling a little lost and I need your expert advice! (and I hope you don't mind how long this post is.)

I am a beauty therapist and I already have my beauty therapy insurance that includes public liability etc. But I am now thinking of offering my own brand candles to my clients (and probably also selling the candles online and via retail stores separately - but in UK only). I have found a workshop/factory that offers exactly the type of product I am looking for.

My questions are:

- Which insurance do you think I need? Public Liability or Product liability or both. This UK based workshop can't give me the exact ratios of the essential oils added to these candles (i.e. they need to protect their formula so no one can replicate it). But they say the product is 100% natural and only uses pure essential oils and that a lot of large health clubs hotels also order from them. They also say that their candles get tested vigorously as legally required and that their labelling is also compliant with the latest laws etc. In this case, do I still need the product liability insurance - or will the ultimate responsibility lie the manufacturer?

- My second question is which companies will offer this type of insurance, designed for white label products. (A friend of mine suggested candles might fall under craft insurance - but I am not crafting these candles myself, I am buying them as white label with my branding on it - would this still be classed as craft insurance - can you suggest some good companies I can look at?

If your own brand stuff harms someone (and yes candles can cause problems) then you are the one who is liable.
You may share liability with the producer but the whole point of white label is that you are wanting the product to be yours, not someone else's.

That brings with it liability being yours. Something a lot of sellers wanting their own brand appear to ignore.

Thank you so much for taking the time to respond. I am happy to sign up for liability insurance.

But with regards to white label products, especially with products such as candles, I wondered: .....From a legal stand point - if the workshop doesn't reveal the full formula, and therefore there is no way for me to verify whether the Essential oils being used in these candles are within legally acceptable limits etc - will the liability then fall with them, or me.

If the ultimate liability falls with me irrespective of the fact whether the manufacturer does or does not reveal the full formula to me, then I will have to look into a private label manufacturer that fully discloses the formulas for an additional fee. This will allow me carry out the necessary due diligence re the formulation/recipe they provide to me before I bring the product to the market.

Also wonder if anyone has used any insurance companies that offer insurance for white label brands, and could suggest some good names please :)

Just my point of view, the initial person bringing into the Europe has the liability normally. There should be no expectation to re-purchase liability insurance.. you will be better of saving your money. Coming from a financial services company -- I can understand your conservative nature, but you will kill your business before this begins in cost terms...
