Incorporation and VISA Process for a US Expansion

Hi all,

I currently work for an Edinburgh-based company and we're looking to expand to the US (not decided on which state yet). The expansion will take the form of a newco being set up in the US to account for new shareholders (me).

I'm looking for advice on the following:

1) Can I incorporate in one business-friendly state (e.g. Delaware) but base myself in another (e.g. Colorado)?

2) What kind of VISA do I need, considering I'll be an immigrant and it's technically going to be a new company? This is the one I'm particularly concerned about, as I'm aware the VISA process can take a long time.

There's lots of information online but very little seems to be relevant for my particular situation.

Any help would be greatly appreciated.

Hi Nick,

I am also looking to do the same for our expansion - perhaps worth a chat as i have done some research in benefits of different states. The Visa you need is an E2 you will need to be eligible in terms of company age and staffing (I think at least 4 required)
