Incoming SMS Scam

Just been checking my Mobile phone account.

On Feb. 1 I received three Premium SMS messages costing £1.25 each within the space of 30 seconds. I can't remember receiving any information on those days!

I then looked further down the page to see that my wife's phone received the same three messages about 10 minutes later on the same day. Neither of us know where these came from or who sent them. The phones don't even have a record of receiving these messages.

So that is £7.50 for what appears to be thin air!

I called my mobile provider and they say tht they cannot trace incoming premium texts.

Anyone have any thoughts as to what I can do?

Has anyone got a cat to kick?

I pay BT Mobile for the spam texts, they then pay the spammer, but they won't tell me who the spammer is. (data protections act :roll: )

They can't do anything about it so sent me to ICSTIS, who sent me back to BT who said that they are only the call centre and not the billing centre.

I asked for the number of the billing centre and they said that they were not allowed to give it out, and that I should contact ICSTIS!!!!!

Basically BT know it's spam, they bill me for the spam, they then pay the spammer, yet they can't tell me who it is or do anything to stop it.

That can't be right can it?

I wouldn't mind if we had actually received the SMS messages because at least then I can text back 'STOP ALL' and that will be an end to it, but when we don't even get them it is impossible to do that. Our phones have no record of receiving any messages on those days.

'Sorry we are unable to help you on this occasion Sir, is there anything else we can do for you today?'

I felt like saying it, .............but I didn't.

If you wish to continue your next port of call is Ofcom.

Basically as I understand it BT should refund you the money whilst the spammer has to prove you requested the premium rate message. Although it doesn't always happen like this :(

This might work - under the same DPA you can ask to see the information held on file about you. At which point when the request comes in they are unable to amend or remove anything from your file (If they're playing by the rules). This might contain the information.

I threatened BT with this one a few years ago when I was getting fax machine calls at two in the morning! - turned out to be QA training in Brum.
