How To Register A Design

Hello,

I am wondering if anyone has experience of registering a design of a product, so not a patent, but a design.

Lets say I want to design a Christmas tree bauble in a certain shape and colour, can I register this?

Whether or not you can register a design is not always a simple question as it depends on the product details and also the surrounding industry. Nonetheless, it is possible that registering a design, or another form of intellectual property, could be very valuable to you. Registering a design is very easy, the big question is whether that registration is ultimately valid (based on prior art). Design Applications in the UK and via the Community Design system only go through a very basic formalities check, no examination as to novelty.

As I said easy to register, but very easy to get wrong. You need to think carefully about what you are registering and get the design drawings right. Also remember you only have a one year grace period to file your design application from the design being made available to the public, otherwise novelty is lost.
