Hi all,

In the process of closing down all activity and then getting my old ltd company struck off as it's no longer needed and hasn't traded for over a year now. Have just received a corporation tax refund cheque from HMRC for previous losses etc which has been made out to the old company name, trouble is, the bank account for the old company has been closed for a good while now, so obviously the check can't be paid in.

My question is, how do I go about getting the cheque re-issued to a different name, is this possible? :| if this has been covered in a past post, would appreciate a pointer as search has so far not turned anything up.

Many thanks for any help on this one.

If the company hasn't been struck off/dissolved yet, you can try writing to HMRC from the company (i.e. on company letterhead) and asking them to issue a new cheque to X as the company's agent. They aren't renowned for being helpful on this however and your only option might be to re-open the bank account.

If the company has been struck off, then there is nothing that you can do apart from reinstate the company, with the associated costs, or just write it off

You may still be within the timescale for submitting a revised corporation tax return for the period creating the CT refund. If you are, try submitting a revised CT return, but this time, fill in the section where it asks if you want the repayment made to someone else, i.e. you. Then sign and submit it, and also send back the cheque asking them to cancel it and re-issue it.

Alot will depend on the "goodwill" of the HMRC employee dealing with your letter. Some are helpful and will do it - others are awkward/lazy sods and will probably leave your letter at the bottom of the in-tray, never to be seen again, or just shred it and pretend it never existed.

It all comes down to how much it's for as to whether or not it's worth doing more than sending a few bits of paper to them and hoping for the best. If it's a lot of money, then it'll be worth opening a new company bank account or spending more time and effort persuading HMRC to re-issue it in a different name.

May not work but I have in the past put cheques in a different account. The checking process stops with the cashier. If they dont notice it'll be credited to the account youve paid into.

I did this with a £1700 cheque from HMRC a few years back.
