Help Serving a Statutory Demand

Help is needed to serve a SD on a general business partnership that is operated from a residential property that is registered to one of the partners of the business. The SD is for over 5K and is a result of a CCJ obtained against the company for the cost of rectification of defective work on their part. To date the business partners have ignored all letters and the CCJ demand. It is over 2 months since the CCJ was issued to them, and NO payment has been made to service their debt to me. The claim for rectification costs was undefended. Location is West Midlands area.

Any help offered would be greatly appreciated.

Ok someone more qualified may correct me if im wrong but a SD is not needed as all that does is award a ccj. As the ccj is granted you now need to issue a winding up petition against the company im pretty sure thats accurate

It is possible to issue a winding up petition without first serving a stat demand however in the case of a business partnership it is unwise to do so. You need to serve, unless it is a LLP ( Limited Liability Partnership) and the address is the registered address, both individuals with the Stat demand. A good local process server should be able to deal with this for you. Worth getting the CCJ and court paperwork checked out before you proceed with a winding up petition too. If the judgment is in default you need to ensure service on the individuals has been effective.
