I am MARIA ,i have small business in Italy , and i supply to a company in UK many years and which recently i found that their company is in Active proposal to strike off but was Compulsory strike-off action has been suspended action under section 1000 of the company act 2006 in a year ago.
My question is , the buyer is not paying me and how should i do to protect my payments to stop them before their close the company

how should i claim ?
should i send an email to Companies House Service ?
is there anyone can help me to give me what can i do now?please .

Hi Maria,

I am not aware of the “compulsory strike off action” but I put a company into voluntary liquidation once and you have to apply to the company that is appointed as “The Liquidator.” Your customer should tell you who this is.

Companies House might be able to tell you who they are, but cannot help otherwise.

From my experience you have little chance of recovering this money so I would prepare for the worse.

No - Companies House process. Not in itself a huge red flag, but coupled with non-payment, a cause for concern.

they as Private Liminited Company had First Gazette on Oct 2019 and then on Dec 2019 the Compulsory strike-off action has been suspended "Action under Section 1000 of the Companies Act 2006 has been temporarily suspended as an objection to the striking off has been received by Register"

My question is that they didnt tell me anything about strike off and now i see the Director is still in Active and the Company status is Active--Active proposal to strike off in Filing history as i metioned on Dec 2019 Compulsory strike-off action has been suspended

so if i want to write to the Companies House, an email , is it still on time to send them ?
and anyone knows how to write them an email to Object ?
is it still on time to send them ?
Please help me ...

How to object to a limited company being struck off in the UK.



If compulsory strike off action is being taken it suggests the company is being run very badly. As Trevor Andrews says your money is probably long gone.

If the company is still shown as active then there is still time to email them. I would write an email like this:

Subject: Company X Ltd Proposal to Strike Off.

Dear Sirs

I object the proposal to strike off X Ltd. This company owes me the sum of £XXX. The invoices are

12345 £X
12397 £X

Copies are attached.

If the company is still shown as active then there is still time to email them. I would write an email like this:

Subject: Company X Ltd Proposal to Strike Off.

Dear Sirs

I object the proposal to strike off X Ltd. This company owes me the sum of £XXX. The invoices are

You can object to the strike off.
Does not mean you are likely to recover your money.

You can write letters to the company, call, email, send debt collectors - but if it has no money then you are getting none.

so what is your suggestion? sitting here doing nothing and waiting ,watching them untill they strike off completly ?

@Scalloway has given you the format for your email above (written before dawn I would think!)

because Companies House Service says once they announce to strike off they had to notice people that they re closing in two weeks , but their strike off has been rejected , so is it still on time to write an email to Companies House Service to object even their pubblished in last year?

Its up to you.

How much money does the company have? If they have some then take legal action to get some of it. Which will cost you.

Objecting simply pauses the situation for a few months. Nothing more.
The same end result will happen eventually - so take action or don't take action, the choice is yours. Simply pausing the closure won't get you any money. Pausing and taking recovery action could - if the company has money or realisable assets.
Or you could pay to wind up the company. May not get you any more than you have now and the end result is ultimately the same as what they are going for - the company is dissolved.

So - what do you want to do? What is your aim in all this?
If we knew your aim perhaps we could suggest ways of achieving that.

If stock/physical items have been supplied (that aren't perishable) then maybe some of that could be recovered even if the money isn't there? It's likely to have been sat around for a year due to covid?

Or is there a limit on how long after an invoice is issued you can recover stock from unpaid invoices ? Assuming you have the right terms on your invoices?

That stock will be sold off to pay all the other creditors - when it might be legally able to be returned solely to you instead?

Hence why I asked what you supplied?

All might not be lost yet?

Getting money from a bank account that is empty, getting money from a company that by that time has no income, getting assets that have already been disposed of ....

Unless the OP is willing to spend money then likely never get a penny. If they do spend money the odds are they still won't see a penny but they can get a report done.
And may get a little money eventually if the company has an asset such as a directors loan account owing to the company.
