Have I been robbed?

Hi Guys, Feeling a little angry and alos a little miffed...

you might of heard of a company called 'CeX' http://www.cex.co.uk/ who buy, sell and exchange DVD's electronics etc etc..

The idea is you hand your goods in either for cash (which is really low amount) or they give you a receipt which acts as a good size credit e.g £50.00 which must be spent in store...

Before you can do any of this you need to become a member and sign up with them with name, address details etc which they store on the computer system..

My problem is I lost my receipt which counts as credit. Went to the Plymouth store today to ask if I can get 1 re-printed so I can use the £50.00 credit for the mass amount of DVD's I gave over..

there basic anwser was so blunt, they might of well said F**k O**!

I couldnt believe it!.. they have my details on the system and they fed me some B*llsh!t story about it being company policy not to re-print credit even If I had lost it?!

Now is this legal?! surely It cannot be?!.. There must be a trading standards act that apposes this?

anyone help out here.. as it feels like I've jsut been robbed of £50.00!

are you saying that because they have your details in the system linking you to the credit that a credit receipt should not matter to prove the credit exists? You could well be right there. Its different to buying a lottery ticket or a gift voucher and then losing it I suppose.

As long as their systems link you to having a valid credit with them I don't see why you should need to produce a receipt. Receipts are usually required as Proof of Purchase simply because no details are taken at the time of purchase to be able to link it to you as proof you paid anything to them. Handing goods over which is converted to cash and details logged onto their system should count. When you signed up to a member what did their T&C say? Were you given an opportunity to read them before signing up that would have stated a receipt was needed else you lost the lot?

Hi thanks for your reply,

Exactly my thoughts on it.. if they have my information on the system, surely they need to keep a record of credit I have obtained from them? even if I do loose the credit receipt... and I deffo did not get a chance to read the T&C's.. they never even offered it to me..

I think i'm going to write a letter of complaint to them, but first I wanted to put it out on here to see what your guys think.

I would imagine that the company will need to keep records of who & when they purchase any second-hand goods from. This may primarily be to assist any police enquiries/investigations regarding stolen goods, etc.

Whilst they can prove that they purchased goods from you, it may not be the case that they will also record when & what you purchase with the credit note that they supply.

In other words, the original credit receipt would still remain valid even if they issue you with another credit note. This would effectively mean that they would have paid you twice & if you were dishonest could still spend the original credit note, if you ever found it.

Thanks for all your comments on this..

I full understand what you say about the credit note and if I found it again.

I think that whole system stinks big time though.. seriously..

I would never EVER EVER use them again! no only becasue of this.. but the down-right rudeness of their staff. there utter ignorance and lack of customer care skills (if they even have any).

I feel cheated out of £50.00 and will be telling people to avoid them at all costs.

I would write to them explaining (politely) what happened and that your credit and personal details are logged on their systems and that you can fetch ID to confirm whom you are.

Dont whinge in this letter. Keep it to a simple explanation and request. Depending on their formal reply, and if they refuse, write to them saying you are forwarding the matter to trading standards. Also ask for a copy of the T&C you signed to which clearly states lost receipts means you lose your credit.

I suspect that the problem is that they wouldn't be able to trace the use of the credit note. You could have used it since its issue, given it away or sold it etc I understand their stance - but, I'm sure that if you write to them and as SLF said, politely explain the situation etc assuming the credit notes are store-specific, they may give you a goodwill replacement. Good luck.
