Are franchisees, employees of a franchisor?

If you are an employe you would have rights under employment legislation, your contract and company employment terms and policies.

A franchise is a chain, say for instance mc d, you are a franchisee when you agree to take the name of the business and trade as that business, from this you have the right to sell all of their products, they advertise the products but you have to pay a price for the privilege. Employees work for the franchises. If you are a franchise you must have a contract?

Yes i have a contract but it sure not say whether i am an employee or not.

I would say that i am and i am afforded the rights of an employee.

I very much doubt you're an employee as you're your own boss being allowed to trade using their name/system/products etc.

Personally, I would be extremely cautious about buying any franchise.

It would be a very unusual franchise agreement that could be construed as being a contract of employment.

Didn't you look into all this when taking on the franchise?

Looking back in May this year you were advised on a previous thread that you were not an employee and that you needed to get legal advice on your situation.
