Fleet Vehicle Insurance

Hi I hope someone can assist with an issue I have been advised of by my insurance broker.

We have a fleet van insurance policy and one of our contractors was involved in an incident last week where he rear ended another car.

Police on scene, Ambulance called, third party was apparently ok but taken to hospital for a check up and his car suffered moderate damage, our van a write off.

Completed all necessary phone calls with driver to the insuance company only to then receive a call on Friday from our broker to say that the insurance company cannot proceed with the claim as the driver was not named on the policy as he should have been as he was under 25. The policy clearly has 2 under 25's named on it with the broker but not this person. I challenged the broker on this as why would we only list 2 young drivers when we had 3 (one of which no longer works for us) and particularly in view of there being no increase to the policy charged. They have said that they see what they can do which frankly is of little comfort.

As a business correct insurance cover is vital in particular to cover our staff, contractors, assets and clients as well as third parties.

Another kick in the teath is that having collected our vehicle from the recovery company and inspected the third parties damaged 11 plate Porsche Cayenne his vehicle should never have been on the road that day as both rear tyres were totally bald with NO visible tread pattern and canvas showing on one of them.

Any advise on what will happen and where we go from here would be greatly appreciated.

Hi thanks for responding. Yes he started after the insurance was taken out. At the time we started the policy we were moving across from Aviva with another broker. As we couldn't cancel the Aviva policy mid-term we left 3 vehicles on the Aviva policy and took 5 across to the new policy. The vehicle he used was on the Aviva policy and finally moved over in October last year along with 2 other vehicles to the new policy. At this time we removed a young driver added this driver. Whilst we got the new certificates from the broker we have only ever received an original schedule which showed the first 5 vehicles we started out with, the broker information and our company information which never indicated endorsements relating to drivers or their ages or excesses. We have never received any further schedule showing additional vehicles and nothing ever relating to drivers.The broker now claims that we didn't remove or add any drivers and I have had to provide a copy P45 to them showing the old driver is no longer with the company. We were never asked to put anything in writing in respect of vehicles or drivers it has always been done over the phone either on their office number or via one of their Managers mobile phones as he seems to work away from the office fairly frequently.The only other things we received when we started the policy was a GAP policy pack with a schedule relating to the first 5 vehicles again has never been updated with the additional vehicles and nothing that related to drivers. The certificates and a commercial risks booklet which was from the underwriters and throughout this book it stipulates drivers must be over 21 and under 65 and refers to excesses between certain ages or with limited driving experiences.I received a letter from broker last week confirming the underwriters position regarding this driver not being added to the policy and that it has been passed to our account manager and any correspondence should be sent to him. I have written expressing my dismay as we have since moved everything insurance wise to them including goods in transit, public liability and employers liability and feel as though we are on our own and are naturally not experienced in such matters. I have spoken to the FSB legal team who have asked us to challenge this in the first instance as they feel that the broker is at fault. Understanding our position would be a great start as right now we are feeling a little lost in a situation that should never have been an issue.I think I have covered it all......any help would be appreciated

Sounds like a simmiler situation a friend was in a few years back, he was 21 company assumed policy was for drivers over 21

He had a bump winter 2011 in ice, no major collision just slid into a parked car outside a school, police called

Found himself being reported for no insurance and was later given 6 points for no fault of his own!

Last i heard he was looking at taking legal action againsed the company, but its useually always down to the actual driver to check the insurance status weather its a company vehcle or not!


So you may have that to contend with should it turn out he was not insured for that vehcle
