I signed a contract with FDGL for 18months in Jan 2009. As I now wish to cancel I have given one months notice. I have been exchanging emails with the company regarding the termination as they say I need to pay £190 re stocking fee. I have quoted various parts of the contract as it clearly states 18months. The latest email from them says 'I am correct that I can terminate the contract after the minimum hire term 18 months but the re stocking fee is applicable until the end of contract which is 48 months. There is nothing anywhere in the contract stating 48 months'. They also say they will accept £140 as a gesture if I pay within 14 days.
I have asked them to advise me where in the contract it states 48 months, I am waiting their reply. I am looking for advise on how to proceed.

Oh the joys of FDGL. Good luck, please update this when/if you get a resolution! I'd be interested to see what happens...

Is it a carbon copy, as in you have the pink/yellow/blue part? If so then you should have the same written on every copy as it imprints through. Most merchant services contracts are a longer contract, but under the Consumer Credit Act 1974, consumers are only bound to 18 months, no matter what the contract states. The re-stocking fee is a way that FDGL makes more money out of you. As far as I'm aware, no other major leasing companies charge this, but I could be wrong. Maybe the small claims court could help if it is fraudulent?

Who have you moved to? Or have you just cancelled all together? Maybe the company that is taking over would put some money towards it for you? I know we can help out sometimes, when required.

They have emailed a copy of page one of the contract. It has been written on '48 months cust signed' . This area on my copy is blank.
This is fraudulent but how do I proceed with them.

I have the pink copy, so if the '48 months' had been written on at the time of signing the agreement it would show on my copy but it does not. I have been in contact with Trading Standards and Citizens Advice today. I will be sending a recorded delivery letter advising them that I have completed my contractual agreement and will not be paying the fee.

An update........After sending my letter to FDGL disputing the fee of £190 and the amendment on 'their' copy of the contract for a 48mth contract. I have today received a letter confirming the contract is terminated without fee. The explanation they give for the amendment is just that it hadn't gone through to my copy!! Strange how everything else managed to get through to my copy.

I witnessed a lease agreement being prepared by a salesman a few days ago. As he'd filled the form in on his lap there's no way that all the information on the original would have gone through onto the customer copy. It's always better for the customer to check the original before the salesman hands them their copy.

Good to hear it has been resolved for you. To add to that, yes the companies do short-term contract, we give terminal for hire for minimum 3 days and we have never taken any re-stocking fee but FDGL does it. To save our customer from paying all this money we established our own sister company providing terminals and this is how we can provide terminals even for 3 days.

Unfortunately I spoke too soon.....The day after I received a letter from FDGL to say the matter had been resolved and they accepted my contract was 18months I received a letter from First Data Merchant Serv saying they want £200 to terminate??? What a disgrace. The issue I have is that I dont have another contract in my possession I thought I had just the one not two agreements.. very confused and unhappy with this.
