Ending public house tenancy agreement - Enterprise Inns won't pay

Hi,

I hope someone can help us. We have until recently been running two pubs for Enterprise Inns. One on a 5 year tenancy agreement and the other on a tenancy at will - as a favour to our BRM.

We gave formal written notice as per our agreements to leave both businesses but are now having issues as follows:
1. Enterprise did not comply with our 'out' date, making us wait nearly two weeks longer until they would send a representative down to finalize paperwork - and charged us rent for this period.
2. Enterprise did not complete a dilapidations survey on our out dates and new tenants are now in the buildings - but they are now saying that they won't pay us as they want to do a dilapidations report first
3. Enterprise originally told us we would receive our payment (deposit, F&F value etc.) within 10 working days of exit. They are now telling us we need to wait another 28 days as they have not done the dilapidations survey.

I need advice as to whether they can actually do all this legally! can anyone help or recommend a good solicitor? We are desperate for the money (around £20k) as it is all we have and it is starting to feel like we are going to end up with nothing

Doesn't matter if it is legal or not, they will try it on if they think they can get away with it.

Our local pub was an EI : the publican first realised it was for sale when a customer showed a 3 month old 'for sale' advert...they hadn't even bothered to tell the tenants that their pub was for sale!



ps maybe you could request that a mod could change the title and content here, your admission that you are uncertain of your legal position is what they want to hear, and a lot of big companies regularly google themselves... If you must post publicly, make it clear that you intend to take this all the way and they will be less likely to try to bully you around. If you write ENT er Pris e In ns in that spaced out illegible format I think it will keep it invisible to google.
