Hi

I have submitted my claim in employment tribunal and have received a date for hearing.

I am bit confused what should I do now before hearing.. I read somewhere before hearing one party prepare bundle of all the document and sends it to other party.. They also prepare extra bundle for the tribunals.

Is this bundle prepared by the claimant or the respondent? If respondent, then when I am supposed to receive my bundle?

    You should have received a document from the tribunal, known as an Order, which sets out what each party has to do with regard to the bundle and witness statements etc. If you have not received that it is possible that the date is not for the hearing but for a case management discussion or pre-trial hearing. The letter with the date for the hearing will set that out.

    have a look at the leaflet which will have been sent to you with the letter acknowledging your claim. This should explain these things.

    As Newchodge says you should have received a "directions order". The Tribunal are now taking the tact of simply ordering that the employer takes the hit on producing the bundle, and are making the order without application.

    I'm just wondering, have you not used the citizens advice etc to help you submit it? If not, why not?

    Thanks for your reply.
    I have received case schedule but was bit confused as I didn't received the copy of bundle until a day before hearing.

    I had my hearing yesterday in which part of the claims have been accepted by tribunal and I have been awarded compensation for salary dues.

    Apart from salary dues I have also requested for future loss and breach in contract which is turned down by ET.

    Hence I am not completely happy with the decision of Tribunal as it overlooks other facts and claims which I have made.

    1. Can I appeal against the decision? If yes, then whether in country court or ET?
    2. If I take compensation claim money from employer as per by judgement by ET.. Will I be in position to put my case for claims which are rejected?
    3. I have not received copy of judgment.. I guess I will receive it in a week. Is there any time frame for it?

    Chris puts it bluntly but appeal success rates are very low. And even having grounds to appeal in the first place is hard in the Tribunals.

    If you are sure that the Tribunal has made a mistake in law then you should get advice from CAB and the like. Although to be honest you appear to have run a full tribunal case without advice - wouldn't it have made more sense to seek advice before the hearing.

    By the way not getting the bundle the day before the hearing is certainly not acceptable - quite unreasonable if it was the respondent's fault.
