Email campaigns - are opt outs a legal requirement?

I have the return email here if you wish me to forward it to you , My 8 year old daughter was in front of the computer when I recieved it as you can imagine I was disgusted that Mr Gibson would reply to the email in this manor!

After sitting back and looking at this whole post i would like to add my tuppence worth.

I work in association with Cy as i know he is good at what he does the email that was sent was in no way anything to do with Mytchmac so Steve please understand that i have never deliberately spammed you. With regards to the info you put together when i was at MAD - this has now been taken down (and was done very quickly) and therefore i beleived we had sorted this out amicably. If i am wrong please contact me by PM and i am sure we can iron anything else out. If not then once again i apologise for my mistake.

Cy your was legal as Eagle pointed out earlier -

Hang on... just playing devil's advocate here - I thought that unsolicited B2B marketing emails were 100% legal. It's only private email addresses that were protected by the govt's legislation?...

This is fact and i am sure we all get annoyed with receiving SPAM but the offer that was made by Cy is a legitamate offer that in no way involves anything dodgy. I am sure (in fact i know) that he wanted to aim at a profiled clientelle of small businesses that want something better out of their marketing budgets. UKBF members are exactly the type of businesses that myself and CY work with as it is where we operate best.

Anyways i dont want to bore you all and as i have said apologies to Steve.

Ok - I guess this thread has highlighted some good points..

Spam is Unsolicited Commercial Email - this can be illegal or legal - it's always wise to get an opt-in - even if you don't think it's necessary.

Opt-in also verifies that the person is interested in your offerings and 'qualifies' the recipient as a prospect too.

The thread is a not only good example of how people feel when they are not opted in to a commercial mailing and are totally unqualified 'leads' (it's probably caused more damage than good to the people sending the mails) - but it's also a good example of how fellow members feel when they feel that another member has abused their position.

I don't think that the senders meant anything malicious, maybe it was nieve and a little thoughtless to bulk mail everyone but we all make mistakes and this mistake, although a little careless isn't earth shaking. Advertising the 'sales and marketing forums' in the email appeared a little desperate and appeared a bit of a cheap shot - but again not exactly earth shattering.

So I'm going to close the thread and ask that it's not brought up in any further threads.
