If you register a domain name knowing that a muti-national company may want to use it because it has their name in it can you profit from it , or can they argue that you are holding them to ransom.

OK , recently a small retailer decided to get into the same business as myself. Check out Tescowindowsdotcom , and now someone has registered similar for asda and sainsburys.

If i had been as smart as i like to think i am how much do you reckon I could have sold that domain to Tesco for?

Hi There

The trick here is the "intention of use" If you are using the domain genuinly then you should be OK, but what is now not tolerated is Cyber Squatting. This is where people buy domains with the intention of just making money out of them.

If its a trade mark like Tesco or Asda then you have to be super careful as they can wheel out the solicitors although from my experience of this they often offer you a decent sum before that happens as the bad press can be a problem for them.

Just don't do this with the sole intention of making money. Its cyber squatting and you are resposnible for all those lost hours searching for decent domains that we all have to do now because of this. It's not tolerated any more.

So what can the person ( it's not me ) who bought asdawindowsdotcom and sainsburyswindowsdot com do with these domains?

He obviously thinks that somewhere down the line that Asda and Sainsburys are going to be doing the same as Tesco and getting into the replacement window market.

Large corporates are likely to have retained trademark attorneys on their books, who I am sure take delight in searching for people who they may allege are attempting to pass off.

I personally would drop the domains, its really not worth the risk.

If I was a major company who had invested millions in my brand, I would not take kindly to someone trying to squat my domain name for their financial gain.

Indeed, if that someone had profited from said domain using my good name, I would instruct my lawyers to recover a percentage of profits made.

Just my opinion.
