Do I need public liability insurance?

I have a limited company and am thinking about hiring ride on toys for childrens parties etc.

The ride on toys are collected from me and taken away by the hirer then returned after use.

My terms and conditions state very clearly that:

- The hirer will be responsible for the safety of the equipment at all times and the people on it.

- The equipment must be supervised at all times by a responsible adult.

The hirer must sign and abide by these terms and conditions.

Therefore my question is, if the hirer has signed the the terms and conditions, do I still need public liability or another insurance instead should a child lean over the side of the equipment, causing it to tip and possibly banging their head?

Any advice would be greatly appreciated.

public liability is typically for those situations where customers and members of the public 'invitees' eneter into your premises for transacting business or merely taking up your offer to treat.

However there is also an onus on you to be adequately insured if and when you are hiring out equipment for commercial use to members of the public wherever that may be.

It is both prudent and a necessity as negligence claims could very well arise in the event of equpment failure, unforseen events, accidents all of whcih could well be attributable to your equipment.

Children have and are deemed to be less responsible and less able to make good value judgements. They are therefore vulnerable as you would be in your business.

Go out and shp around and get the appropriate cover before you begin or suffer the consequences which could end you up in jail if not adequately covered in the event of an accident involving children
