Afternoon all.
Yesterday I received an email from my host regarding a DMCA take down notice, giving me 24 hours to remove the 'offending' products from my store.
Now, we have had a take down order in the past where we were stocking a copyrighted item (unknown to us, we removed the item end of that) however this one really gets to me.
The party who has filed the claim is a competitor. They have picked out a number of items from our store that we both sell and have claimed that they are their copyrighted designs. The only proof they have provided on the take down noticed is 3 website links to products, 3 instagram photos of products and 2 pinterest links.
We purchase our stock from three wholesale suppliers, 2 in the USA and 1 in India. We're not ripping off items through somewhere like Ali Express. We use our own images and own descriptions of the products. 4 of these products are also being sold by other UK online stores. We were also unaware that this particular competitor sold all but one item.
I am of mind to file a counter notice to this take down request as I feel that it is unjust and that them simply providing a product link and instagram pictures doesn't prove that they are their copyrighted designs.
Am I wrong to fight this or should I just let it go?
