Deposit refund

Hi all

I entered in to a verbal contract with a landlord to take over a unit.

He asked me to pay a deposit to take the unit off the market which I did. I was never given a receipt despite asking for one.

Now, due to planning issues, it looks like I may have to pull out.

Would I get my deposit back? No lease or agreements have been signed

Ok, so you have proof of the agreement regarding the deposit.

Did it state anywhere that it was a non refundable deposit?

How much was the deposit if you dont mind me asking?

Did he take the property off the market when you paid the deposit?

As this was a B2B contract you won't necessarily have the same rights to a refund of the deposit as you would with a B2C contract.

With B2C contracts, businesses are generally only allowed to retain that part of the deposit which covers their actual costs (even where the contract states "non-refundable deposit").

Yes I agree with Hash and Bash.

I think time will only tell once you actually make the decision and either proceed or ask for your deposit back.

Be interested to know what answer you get if you do request your deposit back.
