Hi,

Over the past 2 months I have noticed that I have been receiving a large amount of junk / spam

Phone Calls
Text’s

I would consider myself a savvy person with my personal information always opting out of any e-newsletters – post or phone/text messages promoting services and or special offers.

I would think that some how and at some point my details have found there way onto a mailing list and in turn this has been handed out to several companies.

As a test I have carried out a Freedom Of Information request on a company to find out how they have my information. And what do you know my details came from a marketing company.

So with the legal people in this forum do you think it is worth employing the services of a solicitor with an end game of seeking compensation?

It woul depend on whether you ticked in the small print if they could use your details

Maybe have a look at the Information Commisioner website - they could point you in the direction of what to do if you have a complaint

I didn't think companies were covered by the FOI Act - only public authorities and publicly owned companies are.

And even then the commercial departments aren't covered.
i.e. commercial division of BBC

If it's the ICO the OP is reffering to, I thought companies had 40 days to reply?

If your a business you will be surprised how easy it is for marketing companies to get your details. You have a web site so you are putting your details in to the public domain. Trying to prove where your details came from and then prosecuting is going to be very difficult and have you even got grounds to take action?
