The time to ask for this was before you reached a settlement. Why would they sign it now?

What Newchodge said - usually you would make an offer of a settlement subject to a gagging clause. If the settlement has already been reached then there is now little leverage you have to get them to sign anything.

Sorry I should have clarified. The settlement is providing they sign a gagging order that was the agreement we just now need to produce it
