CT41G Form

Hi there. I've recently sacked my businesses account who has been with our business since incorporation (Feb 2008). I've been informed that she may have not filled CT41G Form. I've looked into this found that if you should file this form 3 months after the incorporation of the business.

So questions:
- How do I find out if we have filed the form?
- Am I in trouble if we haven’t?
- What do we do if we haven’t?

Phone the HMRC office that deals with your company's corporation tax and ask them. You should by now have received the company's tax details which will give you the info you need to enquire.

You would have needed to have had the form signed by a director / secretary of the company, if you can't remember doing this then it may not have gone in.

There is a £100 penalty for not having filed the form, sadly its the directors responsibility to file it, not the acountants, so there is little scope for appeal against the penalty. Of course you can always try and get the accountant to pay this if you feel they are to blame.

If its not gone in request a new one be sent to you and get it completed ASAP.....oh and get a new accountant if you haven't already done so! There are plenty on here who offer great service and would be pleased to help you!

When did you pass the form to the accountant to complete?

Does she have proof of sending this off?

You would have received many reminders about this from HMRC so that is a good way to check.

Have HMRC send you a CT return reminder - if so then it is likely that they have received the CT41G.

If not just get a new accountant and get them to sort it all out.

We have recently (December) submitted a CT41G for a company which had been trading for 18 months, HMRC informed me there would be no penalty as they regarded the form as lost in the post, and there is no confirmation to say they actually receive them!

Thank you all!

I've rung and explained the situation. Turns out that the accountant did send the form, but it was filled out wrong and we was meant to re-submit the form, which my accountent failed to do. The lady said there WAS a £100 pound fine, but said she’ll put it down as a failed submission which will waver the fine :p! I was then told where to find the form online which I’ve filled in & sent off. :D


Well done HMRC, for once I have a good word for you!


And agian, thank you all, I was quite worried about all that :redface:!

Just out of curiosity – what proof of postage do you use?
Do you post each form by recorded mail?
