I have recently been using a large courier company for my parcels

In the last 4 months, they have managed to lose 3 parcels.

I have been fighting to get compensation from them and they are dragging their heels and not paying up.

Has anyone got any advice or tips about taking them to court for the amount owed to me (over £300)

What is in the contract about the parcels and did you insure them?

Couriers have watertight terms and therefore wiggle out of every claim they can

My biggest gripe was that you have a package with the name and address on the outside, the same on a invoice inside yet they still loose the package in a warehouse and cannot find it even though its been tracked
They then find the item and sell it off and keep any money the items make in auction

Losing 3 parcels in 4 months is a meaningless figure. How many parcels did you send in that period?

Firstly, have a good look through the terms and conditions you have with the courier relating to lost items and compensation.

Secondly, make a careful note of what they say.

Thirdly, make sure you have complied with the terms and conditions concerning lost items and compensation.

Fourthly, go over (again perhaps) the correspondence you have exchanged with the courier and note any reason(s) they have given for not making compensation payment(s).

    Fifthly, are their reasons correct?

When you have gone through all of the above and if you are still satisfied you are 'in the right', then write to them in a formal way informing them your letter is a Letter Before Action and tell them what you want (compensation), why you want it (breach of specific terms of contract) how you want it paid (cheque or bank transfer) and when you want it paid (specify time and date: 14 days + 2 ought to be sufficient).

Also advise them that if they fail to comply then you will commence an MCOL (Money Claim Online) against them without further notice and will seek whatever costs and interest the court will permit to be added to the claim.

Any doubts then please feel free to post again.
