Company being re-stored needs to trademark a name

Dear All,

My company was dissolved last year due to late filing. At the moment it is in the process of being restored, however I need to register a trademark. Is it possible to do so? although under companies house, the Limited company is dissolved.
Any advice would be greatly appreciated.

At first glance and not being in possession of all the facts (it is amazing what affects intellectual property), it depends who you want to "own" the trademark. Trademarks are personal property (or incorporeal moveable property in Scotland). As such any "legal person" can register a mark.

As your company does not exist for the minute, the company cannot own the trademark application or registration should it become granted.

However, you could personally apply to register the mark and then transfer ownership of the application or the registered mark to your company once it is a legal person again.
