A client has paid around £2,500 into a closed business account by mistake. By the look of things he paid just before the account was closed.

The company was not trading anymore and was closed by the companies house...and the bank closed wth account based on that without notifying me.

Eitherway how do I get the money back from the bank?

I have all the proof of payments and every document.

Will I get full refund or ?

Please advise.

Have you asked your bank if they can help?

If the company was dissolved then any money in its bank account passes to the Treasury Solicitor. Worth asking the bank if there's any other way, but you may need to get the company restored to the register in order to get the money back.

This is the e-mail response from the companies house:

_______________________________

I can confirm that if you wish to restore this company to remain on the register as an active company, you can apply for administrative restoration. The following documents and fees must be submitted in order to make the application:

Form RT01. This form must be accompanied by a filing fee of £100 and can be downloaded from our website.

Accounts for the period ending 28 February 2013. This document must be accompanied by a late filing penalty of £1500.

Annual Return (form AR01) for 1 February 2014. This form must be accompanied by a filing fee of £40 and can also be downloaded from our website.

BV Waiver letter from the Treasury Solicitors. Guidance on how to obtain this letter can be found at https://www.gov.uk/apply-for-a-waiver-letter-wa1 . There will be a cost of around £64.

I hope this information has been of some use to you.

Yours faithfully

Couple of things:

-I used the bank account for other personal transactions other than the business...will that affect how I will get paid?

-The bank says the money has been sent to the Government (Treasury Solicitor)

-I dont mind deductions but looks like Companies House are bent on taking the whole lot.

-What if the client recalls the transfer from his bank?

Thoughts?

Updates:

Spoke to the client who has been told by the bank (santander) that they would refund him the money within 3 working days.

He banks with HSBC.

I will deal with the companies house at later stage once the money has been refunded to the client.

That's great had a feeling the bank may be able to do that.
