Choosing a business name

Hope someone will be able to help me here

I'm opening up a shop in the spring next year - it's a bridal shop. I have a name for the shop in mind but there is already a shop about 25 miles away which uses part of the same name

I already own another business and use this name as part of my other business.

Maybe easier if I give you an example. If the company I owned was called Elegant Events and I then wanted to open a shop called Elegant Bridal Boutique but the shop 25 miles away from me is called Elegant Wedding Gowns - would I be able to do this? or would the other shop have a cause to complain? Really don't want to tread on anyone's toes but my other business is really well known in this area and would like to incorporate the name somehow

Would this be just a shop name or you would register this as a business name? I guess that the other shop owner would in any case complain since you would be a competitor. Things could get more complicated if the other shop is a registered business under that name.

There is no such thing as a registered business name in the UK. You need to make sure that it is clear to customers that you are nothing to do with the other shop. So don't use a similar logo or anything else likely to confuse people, as the other business could take action against you for passing off.

I am in a similar situation to the poster except I have a name which is very similar to another company, is there any way it can be checked out if its legal?

There are a plethora of alternate titles - use a different choice and avoid any future issues completely
