Charge on a property

*I’ve posted this in accounts & finance too as this could apply to both forums*

I’m dealing with the estate of my late farther and it’s come to light that there’s still a charge against his house (my mum still lives there) from when he set up a business with someone in 2004.

I recall from a conversation I had with him a few years ago that the charge had been lifted but for some reason there’s still a charge from Natwest showing on the land registry.

Is it common for banks like Natwest to not bother lifting charges even when they should have? I believe the charge was lifted around 2013.

We want to sell the property and we don’t want this causing an issue down the line.

Hello, I can help you with this query. Ideally, what you need to do is write to the Bank and ask them to remove the legal charge. They may require a legal document called a DS1 to sign and then a solicitor will need to apply to the Land Registry with the same to facilitate the removal of the Legal Charge. However, the property cannot be sold without the bank removing the same so there is no harm in taking action now.

When the bank lifted the charge wasn't there a signed statement given to your father to actually show this?? If there isn't or can't be found then you should go to the bank with a letter stating your request.
Also there should be a lawyer involved in this sort of thing, so if you have a family lawyer maybe you should go pay him/her a visit to know if the person was aware of the bank charge issue. Good luck
