Can a company have commission only consultants??

I know this may have been asked before but I can't seem to find a clear answer so here goes... :redface:

I have a colleuge who is starting a recruitment agency and managed to confused us both on whether you can have recruitment consultants on a commission only basis.

He wants to pay the recruiter a cut of the hourly rate once payment has been received by the client. The recruiter can work from home or his (my colleuges) office.

Can this be done?

In priciple yes however it very much depends on the details of the contracts as to if HMRC will disagree and deem them employees.

The same applies to the risk that the consultants themselves decide they are employees and a tribunal agrees.

Ok :|. So what would you have to put in the contract to make sure they would not be seen as an employee? Some example senarios would help
