We are currently in the process of reviewing our call out procedures when our office alarm is triggered outside of normal working hours and I have a few questions that I am hoping to get help with:
If a person is called out in the evening, in the night or in the early morning what impact does that have on the time they should return to work the next day. Would it be the normal WTR that would apply or should we consider something in addition to this?
Can we cover key holding with a TOIL arrangement or is remuneration required?
If we can do TOIL, what is appropriate. For example, if the employee loves 5 minutes away so from the time of getting a call at 2am, there is the potential that responding to and going back home it would take less than 30 minutes. However it wouldn’t seem right for that to result in 30 minutes of TOIL given the out of hours nature, what is the norm?
Are there any other HR/Operational implications that we need to understand and consider?
