business partnership question

hi i dont know if iin the right section me and my wife wont to open a business partnership is it necessary to have a joint business account legally or is it okay for it to be just on her name

I don't believe there's any hard & fast rule that a business partnership must have a partnership bank account, although I could be wrong. Give HMRC a call to check. Both partners would still need to register with HMRC, independently, as self-employed, however.

It would be very unusual to not have both partners named on the bank account so I would suggest that you might need a Partnership Deed to cover every possible future eventuality, even though married. It would enforce your partnership rights in the event of separation or divorce, etc. Broaching that particular subject with the missus is likely to be the tough part though... Not for the faint-hearted!

Google 'Business Link' and search their site for info on Partnerships, just to make sure you cover all the bases first. They will undoubtedly have a section on Partnership Deeds and why you definitely need one.

You dont have to but I suggest you do to ensure its clear the business is a genuine partnership and to enable cheques to be made payable to the partnership.

Hope you dont mind me asking but have you considered a limited company?
