Hi All,
One of my business partners has another company, lets call it CLHQ, which has been registered at companies house since Jan 2005 as Christmas Lights Head Quarters and has the domain name CLHQ.co.uk (I hope no one really uses that as I am making it up!).
At 5pm last Friday a fax was recieved from a large city law firm, informing him that an American Company, lets call them CLSC (Christmas Lights Service Company Inc) has registered CLHQ and Christmas Lights Head Quarters as UK trade marks and that he needs to stop trading and change his name or face litigation. He was given until today to sign an included letter saying he was happy to do this and that he would destroy everything with CLHQ on it and stop using the domain and email etc. They included copies of two UK Trademarks from the patents office which show that CLSC Inc have registered CLHQ and Christmas Lights Head Quarters as UK trade marks. The application to register these was filed in June 2005 and finally granted in June 2006, both dates clearly after the time which my friends company was registered and started trading as CLHQ.
He sent a fax back yesterday saying that he feels that they have not given him a reasonable amount of time to respond and that he would be seeking legal advice, but where does he go from here?
I can't see how they could have registered a UK Trademark is another company was already trading as that name, but it seems they have.
What is the next move?
