Business name question

I am considering opening a small business running activities for children - a very local business. The business name I love is already used by a small business running the same type of activities on the other side of the country, also just locally to them. They haven't registered the name either as a company name or trademark.
Is there any problem with me running my business using the same name? I can't see that there is - after all there must be many independent shops accross the country with the same name, and I know of several childrens nurseries in different areas of the country using the same business name - or am I missing something? Don't want to end up with a lawsuit before I've even started!
The problem that obviously does present itself is that they have already got the domain name but I could adopt a deviation of it eg rather than plantpots.co.uk I could maybe use plant-pots.co.uk or plantpots-uk.co.uk or the .com address.
Any advice appreciated!
