BILLING EBAY

I intend to send a bill to ebay

They wrongly emailed saying account overdue.. it was not and there are zero problems on it
Still on chat, but been on for ages with numerous agents who clearly do not understand English!

3 have agreed that I can bill them and so I plan to bill them

I got a manager eventually and a billing address, they will be billed for time, i had several agents all agree to the rate in advance of transferring me on (8 agents had the pleasure of chatting to me) !

Several confirmed their first language was not English

Ebay sent a COLLECTIONS NOTICE..
Our account is in good standing with no issues, I checked by logging into ebay, no problems, but the notice is legitimate from ebay as it is in the inbox.

So I wanted to know what was up, should have taken 5 minutes, after 30mins it was confirmed there is nothing wrong with the account and this aggressive and false notice that has wasted 30mins through ebays failure, so I would expect to be compensated for my wasted time.

Then i had a serious of circles, with agent after agent agreeing to a rate, landed at a manger, told him the rate, he agreed (possibly not on purpose but he did) he is a manager of the firm, dealing with a UK customer in English, he should understand what he is agreeing to, if not then he should not be doing the job.

I have their accounts info, they also were advised on a fee schedule for follow up letters, calls and time spent in addition to legal fees for any subsequent court action.

Their half baked service from the Phillipinnes is not good enough and this should have been a quick 2 minutes chat and apology...

Bill has been sent and this will be pursued to the death

They also nicely send a copy of the transcript which documents this too

Plan to quit ebay soon, sick of their service

I assume your a bit miffed, but I don't think they will bother paying to be honest, if you are serious about legal action then again I think you will struggle to get anything to stick, time (unless expressly contractual and pre agreed terms of performance) has no relevance to any dispute

How much have you actually lost in your time?

But if you want to go for it, go for it, would like to know how you get on

Good luck getting them to pay that out.... about as much chance as eBay actually giving a hoot about their seller welfare over buyer final value commissions.

3 agents and a manager all agreed to the rate of compensation
It is documented and time stamped by them
They agreed the initial notice was wrong and nothing was due which is why they agreed in writing (chat) to compensation.

Now I have a copy, it is attached to the invoice, before I let the manager go i told him additional costs for non payment and my plan of action thereafter, basically additional letters, documented time preparing documents for court etc will all be billed at rates I specified.

This will go to court if they do not pay it,

The day after regardless of the outcome I will stop using their service.

I like using legal instruments when I have been given cause to use them.

(Having taken legal advice I have a file in my email with a date on it which is the last date we can begin proceedings against someone for a defamation case)

Many companies have enjoyed paying me money in the past and the size of the company makes little difference to the facts and how they will be interpreted

I knocked up an invoice whilst on hold, printed off and attached a copy of the transcript, all posted today as it happens (I had a parcel to send also)

I know they have a budget to compensate and given my time was already occupied by their non English speaking agents, I have gone this route.

We will see what happens... not a big deal to me, but it is what happened.
