hello ive just started a gothic website called gothic-darkness.co.uk and i have just had the website built there is hower another gothicdarkness.co.uk which is no longer trading which she has admitted this to me via email and the stop trading at the end of 2009 now they are say thy are to to sue me for loss of trading and copy Wright can any please give me advice on this matter thanks

Ready carefully copyright terms and conditions. I and after go to the decision. I think their will be no any issue with your domain as you are using different name including some hyphens.

As your web site is down it is impossible to give any detailed answer. Your website name is very similar to theirs and unless your site looks very different then you could be sued for passing off. As for copyright, then that only comes into affect if you copied images, or text from their site.

I would suggest that you find a different name. It would avoid all confusion and problem.
