I have been the senior manager of a company for over 12 months but have recently been demoted with one days notice, and now have a line manager. I then discovered that my job title was being changed and had been discussed with a member of staff junior to myself before me.

Also in recent months the MD taken to shouting at me in front of other members of staff, this is often bought on by misunderstanding, as the MD is asbent a lot and misses the daily developments in projects, but I never receive any apologies.

I was a very confident manager and coped with a very high work load but am finding it increasing difficult to cope with any work and considering resigning, as I can see no way forward.

Does this behaviour come under constructive dismissal, or a change of role and status under any employment legislation?

Help

You will have to understand that we are not getting the whole picture of course so any replies can only be based on what you have posted.

From what I see, everything within your post is subjective. Has the MD got proof you haven't performed your work to his satisfaction and have you got notes, records, witnesses, of the berating sessions you have received? Without any of those to support your case, they are opinions and perceptions, not
objective facts.

Have you had any formal/informal disciplinary meetings or warnings of any sort?

It is bad management form to chastise in public and to praise in public and demeaning you in front of other staff is totally tasteless and again poor management, but neither of those is viewed as constructive dismissal.

Thanks for your advice, for more information I have no disciplinary actions against me, I received a bonus this year, I have not been informed of any unsatisfaction work and I have bought in at least 30% additional Company business this year. I have also heard very good feedback about me from external contacts given directly to the MD in front of me.

The public berating sessions have been in front of staff who will back me up and external visitors.

In additional to this it was annouced at a recent staff meeting that I am now middle management, and appear that way on the new organisation chart. This was news to me at the meeting, there was no prior consultation or discussions of any description. Following this today I was removed from a project in front of the customers at the meeting, again no prior warning or discussions.

It seems I have no employment rights or protection from a bullying MD.

It also seems no backbone. The first thing you should have done is go talk to the MD and ask him what he thinks he is doing. You should have been assertive and demanded his reasons and demanded a public apology. He has the right to tell you off IN PRIVATE but not in public.

From your posts, and the time gap between your posts, you are not coming across as management material, let alone senior management. If you now have a line manager, ask him.
