Advice needed...

I placed an order on a website on the 31st March.
When I checked the website on the 16th April and saw my order was still only being processed, I emailed the company and asked to cancel the order and for a refund.
They then responded to this email, asking me for more time to process the order - apparently it can take them up to 28 days.
I replied and stated that the processing time was too long, I needed this item quickly and for that reason I would need to go ahead with the cancellation.
On the 9th May, the item arrived at my home in the post.
I have emailed them asking for a return address to send it back to them. This still haven't supplied me with this and have told me I am responsible for the postage to return the item.
I find this absolutely disgusting - why should I be responsible financially to return an item which should never have been despatched to me in the first place!?

I just want to know where I stand legally in this? I don't want to just give in to them as I am so annoyed at their complete disregard to my initial cancellation.

The problem I may have, is that the company is in China.

I paid through paypal so I'm not sure if this is something they could help me with?

Any advice would be very much appreciated!

The first port of call has to be Paypal and they will almost certainly refund you. Email the company you purchased from and tell them that their goods are available for collection. You really shouldn't have a problem with this. Paypal pretty much always comes down on the side of the customer.

PayPal will probably refund you but did you not check the delivery time on the website before ordering? They have a Delivery Guide section with clear details on this with different delivery options and it states the following:

· Standard Order: Generally speaking, it will take 25-30 calendar days for professional dressmaker to tailor your dresses. Also it will take about 1 -3 calendar days for the finished dresses to travel to the destination.

· Rush Order: It will be earlier than regular in 5 days and take 10-15 calendar days for professional dressmaker to tailor your dresses. Also it will take about 1-3 calendar days for the finished dresses to travel to the destination.

·Super Rush Order: It will take 6-10 calendar days for professional dressmaker to tailor your dresses. Also it will take about 1-3 calendar days for the finished dresses to travel to the destination.

Which order type did you choose/pay for ?

All good points made. I didn't look at their website before I posted....this does shed a slightly different light on things. I suspect buyers remorse perhaps or simply not looking at the detail before ordering. Well spotted TWS

EBay and Paypal have good terms of condition for the buyers. You can defend your money when the product is not good in condition or different from what it is stated in the website or delayed arrival. Thanks for the terms and condition which really support to the buyers in legitimate conditions
