Buying a stand in France for exhibition show - VAT Query

Original Post:

I would look at the section on events here.

Thanks. Useful information but I can't find an answer to my question.

I am trying to find out if when talking budget with suppliers, will we be able to get the French VAT refunded or does the vat need to be included in the costs?

As a UK company, is there any VAT to pay on the stand?
The stand will stay in France at all times.

it will need checking, but as the stand is being built and used in France, it is a local sale, regardless of the fact that the client is not local, so VAT would be applied.

This is where even an average accountant can give good advice!

Hi Paul,

I have been told by two different French suppliers that French VAt doesn't apply.

Now I don't understand why you asked the question?

If they are not charging you VAT, you are not charged VAT! Who is going to charge you VAT?

Sounds like they should be charging you TVA as the place of supply is France but if they don't it's their problem, not yours.
What he said!

If a UK VAT registered business is purchasing the stand, as you have described, the Place of Supply is likely to be the UK, not France. So the UK business uses the Reverse Charge to account for the VAT.
(This issue is quite fine, with potentially different outcomes. But, if the French supplier is happy not to charge local VAT, don't disagree!)

The OP said "The stand will stay in France at all times"

Surely that means the place of supply is France?
The Place of Supply rules are complex. Usually the supply of an exhibition stand is not the same as a supply of land or property. The lines are fine, so it is up to the OP how much he wants to press the point.
If he is happy that the French supplier is treating the supply as outside the scope of French VAT, the pragmatic view, which is not unreasonable either, is to agree with him and use the Reverse Charge.
