Hello,
We are a new company looking to import toy products from China, what would be the first port of call to ensure that we are following all the legislation in the EU/UK?
Thanks,
Mike
The requirements are quite complicated but basically toys must meet the Toy Safety Standard EN71 as required by the Toy (Safety) Regulations 1995 in the UK. The same standard applies throughout the EU. That covers most aspects of toys but there may also be additional relevant requirements such as electrical safety for example as well as the General Product Safety Regulations.
You are likely to find that the manufacturer in China can provide you with copies of certification to show that the product complies with EU requirements, but you will need to make sure you ask for the right documentation and also that any testing has been done by an appropriately accredited laboratory.
You can get advice from your local Trading Standards or alternatively there are consultants which can advise you (of which I am one )
You will also need to be aware of legislation such as the Trade Descriptions Act, Consumer Protection Act, etc - there's basic advice available on my website which you may find helpful.
If you need any further information, feel free to contact me - best of luck with your venture.
The other thing you will need to ensure, Mike, is that the names and designs used do not infringe those of any third parties.
You should ask not only for appropriate warranties and indemnities but also for details of whatever searches have been conducted with corresponding advice. If these cannot be provided, then you need to consider what steps you should take yourself to protect your position, as you will be directly liable as the importer.
Additionally, the names and designs used should be protected by trade mark and possibly also design registration to the extent this is relevant and feasible.
Apart from that, the products must be CE marked to show that they comply with the relevant standards, in repect of which Jane can advise you in more detail.
