Hi all legal experts

I need a legal advice on an issue which has seriously affected me financially. In July last year I signed a franchise agreement for recruitment business. Before sigining the agreement, I had closely read out the contents of the website of the franchisor which prompted me go for the business. The franchisor had mentioned on its website like ' You will have the clients waiting for you' and ' You will have the candidates waiting for you'. During discussion with one of the directors of the company, he reitrated the same promise despite other support the franchisor would provide and told me that you would be doing business since the day you would open your business door. However, I sorted out the finances and other allied issues and started the business on 1st October 2004. For providing me supposedly support, the franchisor sent one of their employee to my place of business who did not and could not bring any business what to talk of promised clients and candidates waiting for me. The franchisor had also told me and other franchisees that they have national agreement with big companies like B&Q, TNT, DHL etc. etc. but the franchisor did not pass on any of the accounts to me within the territorial limits of the franchise. I could afford to sustain the financial burden till March 2005 without having any business. When I asked the franchisor's director help me to raise the finances and to give clients as promised, he started pressurising me to sell the business without any considerations. He threatened me for the legal action and bullied me to the point that I had to sell the business for £1.00 to the buyer of their choice. I am not the only franchisee who has faced this situation but there are others as well who have either closed their business by now are struggling to survive without any real support from the franchisor. I believe that the franchisor has conned the people like me by misrepresenting the facts and by providing misleading incentives to lure people to buy the franchise.

Your professional advice would be much appreciated vis-a-vis can I initiate any legal action against the franchisor.

Contact your solicitor immediately and seek advise from him/her. Ask them to check out the terms and conditions of the franchise and also there must be a franchise organisation who will help in these sort of disputes who you can contact and see if others also have complained or if they are even legal?
