Incorrect BTIs

Hi ya.

Some time ago I started to import pet supplements from the USA.

I was advised by HMRC to apply for a BTI to ensure that I had the correct commodity codes. I did, and they gave me a commodity code which I used for a number of similar products.

Recently, I had forgotten how to work the codes out so I rang HMRC. I gave the member of staff the description of the product and the ingredients. To my surprise she gave me a completely different commodity code- thankfully, one that is not subject to the tarrif quota system.

I rang back later to have the code confirmed by another member of staff.

It seems that supplements are not subject to the tariff quotas for sugar, milk etc that pet foods are and thus that when HMRC set my BTI they were seemingly doing so on the assumption that my products are food and not food supplements (even though the product name says supplement and the directions recommend 1 teaspoon a day).

Should I just ignore the BTI or am I legally bound by it and therefore need to have it overturned/corrected.
