Dilapidations - End Of Lease

For the last six years we have leased our current premises. The lease is due to expire in 8 weeks, I have served the appropriate notice to my landlord and we have another premises to move into.

Our current lease is full repairing and puts an obligation upon us to redecorate the premises internally before the end of the lease.

Other than the internal decoration the condition of the rest of the building is much the same as when we moved-in and the survey which we had done at the start is proof of this.

But when we moved in the guttering was leaking and its pain peeling. 6 years later it is still leaking and more paint has peeled off. So how much of the leaking and peeling can the landlord require me to fix?

I have been involved in many inspections of properties at the end of the leases, and also disputes. For what it is worth (and you will need to check with the annex to your lease), just repair the gutter and paint it - all it should be is a weeks hire for scaffolding (tower/cherry picker etc), a few days for a handyman and materials.

Obviously I am assuming that the building is not a massive warehouse type, which will require a little more thought!!

But what you want to avoid is the landlord carrying out this work and it will be charging you much more for the privilege.

Is the building going to be empty for several months, would you say?

If so, then before you do any redecoration, say to the landlord that you'd like to do a deal over the dilapidations and you will pay him £x in return for him agreeing in writing that you don't need to repair/redecorate/etc.

He will go for this - given that it could easily be 2011 before he lets the place, and the work would need doing again.
