I recently resigned from my position and have been given a letter confirming the early release from my notice period, which shoul dhave been 3 months.

My concern is because the replacement they had lined up to take over in just over a weeks time has withdrawn their acceptance, and that they letter I received was only signed by the HR Manager and not my employer.

Does this make a difference to my being released early or is the fact that my replacement pulled out the problem of my employer and not me?

I have also confirmed my start date with my new employer and trying to change this would most likely result in the job being withdrawn.



Any help would be greatly appreciated.

Employment letters are often signed by HR managers and they will be authorised to bind the company in these matters. Even if they are not, you have accepted the letter in good faith and a court would support your position against the company as the manager has held him or herself out as having authority to make the decision. The status of the signatory will depend on the size of the company - a small company may have a director sign and a large one less likely to etc. If your replacement doesn't take up the post that is the employer's problem and has nothing to do with you. They cannot force you to return once you are no longer an employee.
