Were these employees advised in the letters you sent advising them that their positions were redundant from whatever date and that they'd been unsuccessful in applying for the new role or roles, that they had a right to appeal the decision and their redundancy?
A final note for anyone who ever finds this relevant: your employer SHOULD advise you that you have a right to appeal your redundancy in these situations - mine didn't. You should appeal within 14 days of receiving your redundancy letter but it can be longer.My employer held on to our letters...
