Hi Cyndy
One more thing, if I may...? (sorry, shoe horning my way into this thread - similar to a situation I am in with an ex employer)
Are they entitled to claim interest and fees, should they have to proceed via small claims?
Thank you again Cyndy...
Well that’s what I was querying, should there have been or was it not necessary, it would seem not.
Following from my update, my concern now is that it seems they were corralled in to a commission only wage in the belief that this was acceptable and didn’t earn anything in that time. As I...
Well the plot thickens...
After probing further, the chain of events was a little different to their initial description. As previously stated, the role was not working out, so the employer suggested either terminating the employment, they would of course have to work contractual notice, or...
Hi, thanks for the reply
That's a good question, to which I don't have an answer (but will certainly ask what was agreed in more detail). I believe the conversation went some thing along the lines of "it's not working out, could work notice or have a change of role". Implies immediate change...
Hi
I'm just looking for clarification on some advice I have been giving to an ex colleague (previous employment, not related to current situation). My background is finance and accounting, so any HR knowledge I have is related to pay/remuneration.
The person in question was in a role that for...
He has, but there is nothing there to suggest this is an issue. However, as per Alan's post, the contract between the client and OP's employer may have bearing.
Have you approached the potential employer regarding this? Just an informal query should suffice, they will (should) be aware of any...
Strictly speaking, they actually get a minimum of 28 days including bank holidays. There shouldn't be a "splitting" of general holiday entitlement and bank holidays, they actually accrue 2.33 per month, some of which may be allocated to bank holidays.
But are they paying for the training themselves if it is actually funded via grant for that specific purpose?
But in that instance there is no obligation to pay anything other than a predetermined rate. Training fee claw backs relate to the specific costs incurred, in this instance the employer...
If they are financing the fees by a grant (assuming the grant isn't to be repaid), they haven't actually paid the fees themselves, they made a disbursement that was paid for by the grant. In a civil contract it is of course possible to require any costs incurred to be repaid, however, if those...
I didn't say the law said anything about feelings, nor did I say it was how I "felt", perhaps you should reread my post. The reason I mentioned it (maybe you'll get that it was in passing if you reread) is because it doesn't seem ethical that a company should be making specific gain from grants...
You may be able to gain exemption from some of the business/management papers in ACCA and CIMA, and perhaps so of the lower level exams if your degree contained some accounting/finance. Have you checked with ACCA and CIMA on exemptions?
But would the nail hold, since they employer may not have actually paid anything...?
I'm in two minds on this one, having seen both sides in the past, from various perspectives.
On one hand training has been paid and the contract signed, so pay up. On the other hand training has been paid and...
