Now that you say that, I've just read something to similar effect...
"Under the law of England and Wales a partnership is not a separate legal entity from its members (in the same way that a company is a separate legal entity from its members, the shareholders). Each partner can sue and be sued...
(This is just an example to illustrate the scenario...)
Lets say they are builders - Bob & Carl Building Services (made up business name). The negligent partner, Carl, was responsible for building something that fell down the next day.
Would the aggrieved party be pursuing Carl personally...
Hi,
I have a theoretical question-
A partnership with two partners. One of them acts negligently in their role. Can the other partner - who individually has done nothing wrong - be blamed/action brought against him?
I am guessing the answer may depend on what kind of legal partnership they have?
I'm no authority on the subject but ultimately, no contract = no rights.
Perhaps if someone can advise you where you stand *if you had a contract*, you could then very nicely put the argument to your boss and try to convince them. But as I say, without a contract you're just relying on your...
Hello,
Would appreciate any help with what I hope is a simple enough question.
I am doing my self assessment for 12-13 and it is telling me that I owe £134 in tax. I believe I have already paid this as I received a letter 6 months ago telling me there was a £137 underpayment for the 12-13 tax...
I've just signed up as a freelancer and agree with what others have said.
So many jobs posted have one line descriptions and I have to sit and write out a 'proposal' when I don't really have a clue what's needed.
I'm persevering with it anyway as I've just started out and if nothing else, it's...
You raise a valid point re knowing job values. And indeed, a tradesperson could potentially claim not to have secured the job at all to avoid commission payments.
Contracts would be signed prior to leads passed over and there would have to be a verification stage with the lead to confirm that...
Hi Roy,
Just to resurrect a whole thread, I am interested in the idea of how a commission based lead site could work.
What would be seen as a fair commission figure for securing a job? As a percentage of the value of the job secured, say? And would it have to be exclusive of the materials...
Thanks for the reply.
If when I come to filing my return, I use the new trading name, will HMRC be pernickety about it not matching the one used in my registration? If not, I guess I need do nothing.
When I registered as self-employed with HMRC, I supplied them with a trading name for my business. Since then, I have slightly changed my trading name.
I've logged in to my account online and cannot find anywhere to update/change this - does it matter? Or is the trading name not all that...
Hi all,
I'm looking to get a consensus on tradespeoples opinions of sales leads. Here are some specific questions -
1. Would you/do you buy leads? If not, what are the reasons?
2. How much would you be willing to pay for a lead? (and what is your trade, for comparison purposes).
3...
