Are the FOS saying that because Lloyds have to exhaust all avenues to recover the money from you before going to the govt for the 75% the fact that they have had the money means they have done it already and you should only be liable for the 25%?!

Westcot probably have not bought the debt - they have just been asked to try to collect the money. I have dealt with them - paying them what I can reasonably afford.
They would have to get a CCJ before bailiffs can call - but it would probably be only if you defaulted on any arrangement made...
