Need some help on my car guys

Right, I will firstly start off by saying I hold my hands up I should of checked anyway, but I didn't think about it (and I don't think anyone else does until they get the reminder letter).... ANYWAY explaining time..

Parked my car where I always work, going to work this morning, get a text from a friend to say went past my car and it was clamped..... said my tax had ran out..... (which when I went to see it had by 4 months :\).. I did not receive ANY REMINDER.. I rang the number, they said it would cost £260 to get car release but not until Monday.. when I show I have paid for the tax, I get £160 back from them.. I always have paid my tax on time, ALWAYS, I have my insurance, MOT etc... I have always done everything by the book... Like I said above, they send reminders out for tax... why didn't I receive this letter?? Also, they said they logged the fact my car had no tax in February, did I hear anything from them.... NO..... NOW the problem I face is, I went to tax my car online after work (not using the reminder because I have not got one from DVLA) and it asks for reg and document ref (from log book), went to look for logbook, but have not got it... and NOW I remember that when I first bought the car (on finance) from a car shop, they said it takes 2 weeks for the logbook to come (or something).. I sent off my part of my old logbook to DVLA to say I am no longer registered with that car, and what im thinking is 'the car shop' has not sent my details to the DVLA for the new car (if this is making sense so far).. so I am going to the 'car shop' tomorrow to see if anything is on there system about my logbook, because even my parents don't remeber me having the logbook for the new car. When I first bought the car from the 'car shop' nearly a year and a half ago, I taxed the car for a year (which is why I forgot about the tax, and the fact I had no reminder to say about the tax)..

I know this sounds very confusing but can anyone give me any advice?

p.s as I said I hold my hands up, I should check but as most people do, they await for the reminder for there tax, however I had no reminder and I didn't even realise the tax needed to be updated. I always paid my tax straight away..

Also, even though its the weekend, because I paid the £260 straight away, to release the car, they said not until Monday, is this right??? Can they do this???

That is what I am checking up on tomorrow Poppy.. why I have received NO reminder from DVLA about my tax and why I received NO other 'warnings' of any kind from them. I mean yes, I should check, but sometimes you do forget, and when the reminder comes you know you need to tax the car.. which I have always done.. What I am thinking is, when I bought the car, the 'car shop' have not sent away there part of the log book to say the car is in my name, so I will ring tomorrow and find out exactly why I have not received nout..

It will not make any difference.

The a caveat for SORN is that if they are incompetent and you fail to check that you receive a DVLA notification acknowledging that you have declared a car SORN, they can and will fine you. So always post documents to the DVLA via a postal method that can be traced.

Only a government bod or large organisation could think and behave in such a way but they do. Damanding money with menance is a speciality that you need to be above the law in order to do so. If the little people try it it's called theft.

The tax disc is stuck to the passenger side of your wind screen, it clearly and boldly states the date of expiry (well mine does), thing is, its meant to be VISIBLE.

Have you never ever looked at it as you approach your car? or when washing it etc?

And how did you manage to insure it? or is that out of date as well?

Thats another good point. You might not have been insured as my insurers state the vehicle must be Taxed and M.O.T tested to prevent voiding insurance. (Unless stated as SORN or insurance company notified in writing first etc)

Any little loophole they can find and they'll use it.

You don't need valid road tax to get insurance, AFAIK. But you do need insurance to get road tax.

To OP, as said, if you didn't get the log book then likely they don't have your address for a reminder. The reminder is just that. a reminder. But the onus is on you to check it's valid. I understand your frustration but you won't be able to defend this by claiming you didn't get a reminder.

Right been sorting this out with a family member all day today.....

Went to the 'carshop' they said they photocopy records of logbooks, however they then couldn't find the documents, so they then said because my car was sent from Scotland (because I seen it on the internet through the same company) the logbook would be on there system.......... complete bullshiit right??

Anyway, we then went to the tax office, it turns out my car was registered to an unknown address in Cardiff to a different name aswell (my name is Christopher, it was under Christian).. they couldn't see there and then the original documents, they said to ring DVLA Swansea and they can access that (I will come to that later)..

We then went back to the 'car shop' and they said you had all your letters from us about finance with the right address, the address they have on there system is correct, so they said there was no mistake by us.. however they can't produce the document because it was 'last year' i bought the car from them...

So we then rang DVLA Swansea, told them whats happened, I asked if they had the original document, they said yes, they asked to confirm my postcode, and they said no.. on the original document from the 'carshop' it was *this address* (which was no my address) and the logbook got sent back to DVLA Swansea as undelivered on 14th Feb....

Car was taxed today :) logbook is coming and all details have now been changed, however the ongoing battle continues with another trip to the 'car shop' tomorrow to say they sent off my details completely wrong with a wrong name as well, they didn't even put a postcode on the document the carshop send to DVLA...

Again, I hold my hands up, I should check myself, however as most people do, they rely on the reminder form..... and the reason i didnt have it, was because the car shop registered my car to a non address and a different person!!

Sorry to bring this up again.. We are still working on this matter.. Had a fresh fine through the post the other day, which we are appealing.

I have had the original document of the logbook the 'carshop' sent to the DVLA, through this morning, and not only is it the wrong address, but they have also forged my signature at the bottom.. I will be ringing up the DVLA again now just to see why they don't check up on things, but we will be heading down to the 'carshop' in due course.

From a tax/clamp problem, to a fake address and forged signature.. this is getting worse and worse!

Again, as i've said from the beginning, yes it is my responsibility to check the tax disc, but as most people do, they await the reminder.. I have never missed a payment of my tax EVER, just funny how when I did, was because I bought the car and the 'carshop' messed up completely.

I'm not totally sure why you feel that you have been wronged. You didn't tax your car and got caught, when this happens you get fined. Far simpler to pay it and go on living your life than to create an ongoing saga, multiple journeys, phonecalls etc and then pay.
If you don't remember to do something then it's entirely your fault and you must deal with the consequences. If you forget to go to the gym, you get fat. If you forget to eat, you die. If you forget to tax your car, you get fined.

I paid the fine.. have you not read what this has turned into... wrong address and information supplied by the carshop to the DVLA and a forged signature.......... buddy, don't jump in unless you have read everything.. As I have said from the beginning, burden falls on me to tax the car yes, but with my older car did I have a problem, NO paid the tax ontime, never a problem.. READ and then reply mate

Perhaps you haven't read your own posts? The post before mine is all about a new fine which for some reason you think you shouldn't pay and you blaming others for not reminding you.

Let's put it this way, if you found out your vehicle was not even registered to you and had a forged signature of yours done, you wouldn't think anything of it then....... *yawn* I don't think you'd leave it alone would you.....

I can't say it's a situation I would put myself in, I buy from reputable dealerships and tax cars when the tax is due.
Should I not have the V5 despite a sufficient passage of time I would address the problem then rather than letting things slide and then blaming others for my fines and incorrect paperwork.

Do you really think I put myself in the position for the fun of it.. OF COURSE I love to have fines.............. I have used 'carshop' for a reason, as who I bought it from are a VERY large company in the UK, so YES they are reputable, but thank you for pointing that out. Clearly you have no idea, and have some what of a 'perfect life' there Lee.. Well done for achieving your perfect status!

LOL!! ASDA is large, and reputable and they are everywhere in the UK.. so is the 'carshop' I purchased my car from.. any differences other than one is food and the other cars.................

I'm done with this now sir, I am sure that it is all someone else's fault and that disputing fines for not taking your car is the correct approach.

This is not only about the fines... I am appealing one of the fines and seeing what the 'carshop' have to say for themselves, now I have the original document they sent to the DVLA with the incorrect address and name for myself and also the forging of my signature..... Something I am the most unhappy about NOT THE FINES as you keep stating..

As i've said from the beginning, yes I do have a responsibility to check HOWEVER majority of car owners await a reminder before taxing the car.. ALSO you need that reminder to tax the car ANYWAY..

I would just like to say, following legal advice etc, and speaking to the car shop, everything has been resolved and they (as we got told from the legal advice team) took a form of responsibility, as they provided the wrong information to the DVLA, which mean't not being able to tax the car when needed (with a reminder).

Thanks for the doubters.. I don't like to give up on things especially when I KNOW I didn't purposely go out of my way for this to happen. As I have said, always paid tax on time with my old car, never an issue, until now...

=D they are paying the fines, simple as that!
