Making a Will (Scotland)

Making a will is one of these things that I need to do but I never seem to get around to it. Does anyone have any advice on how my wife and I can get our wills made up by a solicitor or whatever who will not rob us blind or use small print that takes funds from our estate when we pass on?

I doubt that my business interests would complicate things to any great extent. I am just self-employed and I don't have a registered company. I work from home and there are really no tangible assets in the business. The way things are looking now it will just die with me.

I am aware of the will aid schemes, etc. but these get very mixed reviews. We are obviously prepared to pay a reasonable fee.

English and Scottish inheritance law have some similarities but are not the same.

Same basic ideas almost certainly apply

work out what you want to do with your estate but thereare restrictions on exactly what you can and can't do regarding gifts to spouse and children
don't appoint the solicitor as an executor (can be costly)
get quotes from more than one
ask if that is a fixed cost and if there are any extras - find out all costs

I seem to see a fair amount of advice against using DIY schemes? I think their man fault is that you will never know if you did it right or not.

I would agree with this, a lot of the pre packaged schemes are tailored to English law and, depending on your circumstances could be challanged in Scotland.

For instance, under scots law you cannot disinherit your children. (I think!)

By coincidence, a guy knocked my door the other day selling wills for a company called JMD Associates. He gave a leaflet and took my contact details saying that someone would be in touch by follow up. Today I got a letter from them offering me a will for £29.99.

They have an office in Glasgow (20 miles from me) and they say that someone will come to my home to do this. I do my sums and conclude that it will take about £7 or £8 in petrol and at least two and a half hours for someone to make this visit all for a total of £29.99.

It does not compute. There is a catch. :(
